1. Safety, Training and Product Use
Some products and equipment offered by Diver City, particularly diving and marine equipment, may require specialist training, technical knowledge or prior experience before use.
The customer is responsible for ensuring they have the training and experience required to use the product correctly and safely, following the manufacturer’s operating instructions and warnings, and consulting a qualified instructor or specialist where necessary.
Equipment must not be used contrary to the manufacturer’s instructions or outside its intended purpose. Stop using any product suspected of having a fault that may affect safety.
To the extent permitted by law, the company is not responsible for damage caused by misuse, failure to follow safety instructions, or use without the necessary training. This does not exclude any legal responsibility or obligation of the company, including responsibility relating to product defects.
2. Shipping and Delivery
Diver City offers delivery within the State of Kuwait and to international destinations available through the website. The company selects a suitable shipping method based on destination, service availability, speed and cost.
Available shipping charges are displayed before the order is completed. Delivery times are estimates and may vary due to destination, transportation, customs clearance and circumstances beyond the company’s reasonable control.
International shipments may be subject to customs duties, taxes or import charges imposed by the destination country. The customer is responsible for such charges where applicable under the relevant rules, with known charges and responsibility for payment explained before purchase where possible.
If delivery becomes impossible or a significant delay occurs, the company will contact the customer where necessary to explain the available options, subject to applicable customer rights and legal obligations.
3. Returns, Exchanges and Refunds
Returns and exchanges are subject to the Returns, Exchanges & Warranty Policy published on the website, which forms part of these Terms & Conditions.
That policy explains the return period, product-condition requirements, shipping costs and refund process. No provision may be interpreted as waiving any mandatory customer right under applicable law.
4. Warranty and Defective Products
Warranty terms and duration vary by product, brand and supplier. Available details are stated on the product page, invoice or accompanying warranty document.
If a product arrives defective, damaged or not in conformity with the agreed specifications, please contact the company so the matter can be handled in accordance with the applicable rules in Kuwait.
Warranty, return, repair and replacement requests are handled under the website’s published Returns, Exchanges & Warranty Policy, without prejudice to any rights or obligations established by law.
5. Limits of Company Liability
Diver City’s liability is determined according to the circumstances and applicable laws. To the extent permitted by law, the company is not responsible for damage caused by misuse or use contrary to the manufacturer’s instructions or the product’s intended purpose.
This does not exclude any legal responsibility or obligation of the company, including liability relating to product defects or consumer rights established by law.
6. Privacy and Customer Data
Diver City respects customer privacy and uses customer data to the extent necessary to process orders, complete payments, deliver products, provide customer service, handle returns and warranty requests, and meet legal obligations.

الشروط والأحكام
1. سلامة المنتجات والتدريب والاستخدام
بعض المنتجات والمعدات التي يوفرها متجر Diver City، وخصوصًا معدات الغوص والمعدات البحرية، قد تتطلب تدريبًا متخصصًا أو معرفة فنية أو خبرة مسبقة قبل استخدامها.
يتحمل العميل مسؤولية التأكد من امتلاكه التدريب والخبرة اللازمين لاستخدام المنتج بصورة صحيحة وآمنة، والالتزام بتعليمات التشغيل والتحذيرات الصادرة عن الشركة المصنّعة، والاستعانة بمدرب أو مختص مؤهل متى كان ذلك ضروريًا.
لا يجوز استخدام المعدات بطريقة مخالفة لتعليمات الشركة المصنّعة أو خارج الغرض المخصص لها. كما يجب التوقف عن استخدام أي منتج يُشتبه في وجود خلل قد يؤثر على سلامته.
لا تتحمل الشركة مسؤولية الأضرار الناتجة عن سوء الاستخدام أو مخالفة تعليمات السلامة أو الاستخدام دون التدريب اللازم، بالقدر الذي يسمح به القانون. ولا يخل ذلك بأي مسؤولية أو التزام قانوني يقع على الشركة، بما في ذلك ما يتعلق بعيوب المنتجات.
2. الشحن والتوصيل
توفر شركة Diver City خدمة توصيل المنتجات داخل دولة الكويت وإلى الوجهات الدولية المتاحة عبر الموقع، وتختار الشركة وسيلة الشحن المناسبة بحسب الوجهة وتوافر الخدمة والسرعة والتكلفة.
تُعرض رسوم الشحن المتاحة قبل إتمام الطلب، وتكون مدد التوصيل تقديرية وقد تختلف بحسب الوجهة وإجراءات النقل والتخليص الجمركي والظروف الخارجة عن السيطرة المعقولة للشركة.
قد تخضع الشحنات الدولية لرسوم جمركية أو ضرائب أو رسوم استيراد تفرضها دولة الاستلام. ويتحمل العميل هذه الرسوم إذا كانت مستحقة عليه وفقًا للأنظمة المعمول بها، مع توضيح الرسوم المعروفة ومسؤولية تحملها قبل إتمام الطلب متى أمكن.
إذا تعذّر توصيل الطلب أو طرأ تأخير جوهري، تتواصل الشركة مع العميل عند الحاجة لتوضيح الخيارات المتاحة، مع مراعاة حقوق العميل والالتزامات القانونية المطبقة.
3. الإرجاع والاستبدال واسترداد المبالغ
تخضع طلبات الإرجاع والاستبدال إلى سياسة الإرجاع والاستبدال والضمان المنشورة على الموقع، والتي تُعد جزءًا من هذه الشروط.
توضح السياسة مدة الإرجاع وشروط حالة المنتج ورسوم الشحن وآلية استرداد المبالغ. ولا يجوز تفسير أي بند فيها على أنه تنازل عن حق إلزامي مقرر للعميل بموجب القانون.
4. الضمان والمنتجات المعيبة

5. حدود مسؤولية الشركة
تُحدد مسؤولية شركة Diver City وفقًا لطبيعة الحالة والأنظمة المعمول بها. ولا تتحمل الشركة مسؤولية الأضرار الناتجة عن سوء استخدام المنتجات أو استخدامها خلافًا لتعليمات الشركة المصنّعة أو الغرض المخصص لها، بالقدر الذي يسمح به القانون.
